To change or not to change your last name after divorce

July 15, 2012  |   Posted by : Orange County Divorce Lawyer  |   Children,Divorce,Family Law,Name Change   |   0 Comments

In a dissolution of marriage the question will arise, should I change my last name and return to my maiden name?  This is a personal preference depending on the facts of each person.  For example, if you have become a citizen or are a lawful permanent resident changing your name after divorce can mean you will also have to change your drivers license, citizenship certificate, resident card and so on.

These changes can be time consuming and costly.

Another consideration is children of the marriage.  If you return to your maiden name, you may have to answer questions in the future about why your last name differs from that of your children etc..

Whatever your preference let your attorney know if you would like your name changed in the divorce petition, if so there is no additional cost.

Domestic violence accusation

Domestic Violence accusations

Domestic Violence accusations can substantially affect child custody and visitation if factual.  The California Family Code Section 3044 creates a rebuttable presumption that an award of sole or joint legal or physical custody of a child to a person who has perpetrated domestic violence is detrimental to the best interests of the child.  It is thus extremely important for a person who has been falsely accused of domestic violence to seek the assistance of competent and experienced attorneys to defend against the finding of domestic violence.

Domestic violence charges can be civil or criminal; therefore, you may need to hire a civil family law attorney and a criminal attorney to defend you in the criminal action.

You have the right to remain silent and not say anything to incriminate yourself, therefore a Family law attorney may often seek a continuance of the civil domestic violence action and will not proceed with the domestic violence case in family court until the criminal case is determined. Attorneys do not want anything you say in the family court case to be used against a client in the criminal matter.

At the Orange County domestic violence law firm , there is a staff of attorneys that are well-informed, concerned and ready to champion for your legal rights. Therefore, if you or your family are victims of domestic violence or if you have been wrongfully accused of domestic violence, rest assured we are ready to assist you and your family with the necessary legal steps.

Katie Holmes and Tom Cruise Divorce

July 03, 2012  |   Posted by : Orange County Divorce Lawyer  |   Divorce,Family Law   |   0 Comments

As the divorce of A-list celebs Katie Holmes and Tom Cruise shocks people around the world, the religion known as Scientology can’t help but be brought up in a few discussions. To many, Scientology is not well-known and the rituals are unfamiliar. For example, the rituals regarding divorce. Divorce in other religions is often times much simpler; Jews must sign a contract, Mormons must undertake a ‘sealing cancellation’. The Church of Scientology, however, believes that the struggles in a marriage result from unsolved and undiscussed problems and that communication is the best way to solve these problems. The Church tries to restore the marriage as best as they can through therapy, courses called ‘How to Improve Your Marriage’, and in crucial situations, counselors help the couple through exercises. Communication is such a big part of Scientology that during the wedding ceremony the couple completes the ARC triangle or “affinity, reality, and communication”. The former Hollywood couple believed so much in communication that they stated in their vows that they would not go to sleep at night without resolving any problems they had.

For now, it’s unclear as to if Katie and Tom have or will undergo therapy through the Church, though rumors state that Katie’s reason for filing for divorce was because she no longer wanted her and her daughter, Suri, to be involved in Scientology. The Church of Scientology has strict rules preventing members to communicate with disconnected members of the faith who are branded as a PTS, or potential trouble source So even if all Katie Holmes wanted was to convert religions, divorce is pretty much mandatory in a case like that.

List of advice for divorced parents

July 01, 2012  |   Posted by : Orange County Divorce Lawyer  |   Children,Divorce,Family Law   |   0 Comments

Divorce is difficult. For a child, it can be even more difficult. Children are often left being confused as to why their parents are divorcing, sometimes even putting the blame on themselves. Jill Greenstein, a psychologist at Putnam Valley Elementary School, formed a group for children whose parents were separating or divorcing. The group, known as ‘Banana Splits’, came up with a list of advice for parents:

1) Spend alone time with all your children.
2) Tell the truth and don’t break promises or lie.
3) Don’t fight, yell, etc. in front of your children — it makes your children scared and worried.
4) Help your children with their homework.
5) Share important information with your children.
6) Listen to your children and pay attention to them.
7) Have patience with your children and try not to get too angry.
8) When you’re angry, try not to take it out on your children.
9) Communicate your feelings.

Don’t hesitate to ask your children how they are feeling and don’t be afraid to share how you are doing.

One should always make attempts to save their marriage if they still love each other, especially when children are involved. A divorce attorney is recommended only after all other options have been explored. If you need a divorce lawyer in Orange County, our Tustin divorce firm can help you.
